These Terms of Service (“Terms”) govern your access to and use of TourVoz, including our websites, platform, software, features, tools, and related services (collectively, the “Services”).
These Terms are provided by TourVoz (“TourVoz,” “we,” “us,” or “our”).
By creating an account, starting a free trial, purchasing a subscription, or otherwise using the Services, you agree to these Terms. If you use TourVoz on behalf of a business or other organization, you represent that you have authority to accept these Terms on its behalf.
If you do not agree to these Terms, you should not use the Services.
1. About TourVoz
TourVoz is a software platform designed to help travel businesses and professionals create, manage, and operate their own travel websites and related digital operations.
Depending on your plan and available features, the Services may include website management, tour and destination content, traveler inquiries, lead management, multilingual functionality, communication tools, integrations, custom domains, review-related features, and other website or business-management tools.
TourVoz provides technology and software services. TourVoz is not a travel agency, tour operator, accommodation provider, transportation provider, destination management company, or other supplier of travel services offered through customer websites.
Any travel product, itinerary, experience, price, booking arrangement, representation, or service displayed or offered through a customer website is provided or managed by that customer or its relevant suppliers, not by TourVoz.
2. Accounts and Eligibility
You must provide accurate and reasonably complete information when creating and maintaining your TourVoz account.
You are responsible for:
- maintaining the confidentiality of your login credentials;
- controlling access to your account;
- keeping your account information current; and
- activities performed through your account by persons you authorize.
You must notify us promptly if you become aware of unauthorized access to or use of your account.
You may use TourVoz only if you are legally capable of entering into a binding agreement and your use of the Services is permitted under applicable law.
3. Free Trials
TourVoz may offer a free trial for eligible users.
Unless otherwise stated at the time of registration, the standard TourVoz trial period is 14 days.
Trial accounts may be subject to feature, content, usage, domain, or other limitations. Features available during a trial may differ from those included in a paid plan.
At the end of a trial, continued access to certain Services may require selection of a paid plan.
TourVoz may modify trial eligibility, duration, limits, or availability where reasonably necessary to prevent abuse or reflect changes to our Services.
4. Plans, Features and Usage Limits
TourVoz may offer different subscription plans with different features, allowances, and usage limits.
The features and limits applicable to your account are those described on our Pricing page, checkout interface, account dashboard, order information, or other applicable plan description at the time of purchase.
Certain features may be subject to limits, including limits relating to tours, destinations, pages, posts, team members, inquiries, integrations, storage, or other resources.
We may improve, modify, replace, or discontinue individual features as the Services evolve. Where a material change significantly affects a paid subscription, we will take reasonable steps to provide appropriate notice.
5. Fees, Billing and Renewals
Paid Services are billed according to the pricing and billing cycle shown when you subscribe.
Unless otherwise stated, subscription fees are charged in advance for the applicable billing period.
Where recurring billing is enabled, your subscription may automatically renew at the end of each billing period unless you cancel it before renewal.
You are responsible for providing valid billing information and maintaining an authorized payment method where required.
Taxes, duties, or similar governmental charges may apply depending on your location and applicable law.
We may change our pricing from time to time. Pricing changes will not retroactively alter fees already paid for a completed billing period.
6. Cancellation and Account Changes
You may cancel or change your subscription using the account functionality made available by TourVoz or by contacting us where self-service functionality is not available.
Cancellation generally prevents the next renewal and does not automatically create a refund for a billing period that has already begun, except where required by applicable law or expressly stated otherwise by TourVoz.
After cancellation, expiration, or termination, access to paid features may end or become restricted.
7. Customer Content
“Customer Content” means content, information, files, text, images, logos, tour information, destination information, business information, website materials, and other content that you or your authorized users submit, upload, publish, store, or manage through TourVoz.
As between you and TourVoz, you retain ownership of your Customer Content.
You grant TourVoz a limited, non-exclusive right to host, copy, transmit, display, process, and otherwise use Customer Content only as reasonably necessary to provide, secure, maintain, support, and improve the Services.
You are responsible for ensuring that you have the rights and permissions necessary to use and publish your Customer Content.
8. Your Travel Website and Your Customers
Websites created or operated through TourVoz are managed by independent TourVoz customers.
You are solely responsible for the travel business conducted through your website, including where applicable:
- tour and itinerary descriptions;
- prices and availability;
- representations about destinations or services;
- booking or inquiry responses;
- cancellation and refund policies;
- licenses and regulatory requirements;
- taxes and fees;
- customer communications;
- supplier relationships;
- delivery and performance of travel services; and
- compliance with laws applicable to your business.
TourVoz does not become a party to transactions, bookings, arrangements, or agreements between you and travelers merely because the Services are used to facilitate a website, inquiry, lead, communication, or related workflow.
9. Traveler and End-User Data
Your website may allow you to collect information from travelers, prospects, website visitors, or other end users, including inquiries, contact information, and lead information.
You are responsible for determining what information your business collects, why it is collected, how it is used, and how long it is retained.
You are also responsible for providing any privacy notices, cookie disclosures, consent mechanisms, or other disclosures required by applicable law on your website.
Where TourVoz processes personal information submitted through your website solely to provide the Services to you, TourVoz generally acts on your behalf as a service provider or processor.
10. Acceptable Use
You may not use TourVoz to:
- violate applicable laws or regulations;
- engage in fraud, deception, or misleading commercial practices;
- infringe intellectual property or privacy rights;
- distribute malware, malicious code, or harmful software;
- attempt unauthorized access to TourVoz systems or other accounts;
- interfere with the security, integrity, or performance of the Services;
- circumvent usage limits;
- send unlawful spam or unsolicited communications;
- impersonate another person or business; or
- use the Services in a way that creates unreasonable security or legal risk.
11. Third-Party Services
TourVoz may allow you to connect or use third-party products and services, such as domain providers, payment providers, analytics services, communication services, review platforms, social networks, or other integrations.
Third-party services are provided by their respective providers and may be subject to separate terms and privacy policies.
TourVoz is not responsible for the availability, performance, content, policies, or actions of independent third-party services.
12. TourVoz Intellectual Property
TourVoz and its licensors retain all rights, title, and interest in the Services, including the TourVoz platform, software, interfaces, designs, documentation, trademarks, branding, and related technology, excluding Customer Content.
These Terms give you a limited, non-exclusive, non-transferable right to access and use the Services during the applicable trial or subscription period.
13. Service Availability and Changes
We work to provide a reliable service, but no online service can be guaranteed to operate without interruption.
TourVoz may occasionally be unavailable because of maintenance, upgrades, security events, infrastructure issues, third-party service failures, or circumstances outside our reasonable control.
We may update the Services, release new features, change interfaces, or retire features as the platform develops.
14. Suspension and Termination
We may suspend, restrict, or terminate access to the Services where we reasonably believe that you have materially violated these Terms, created a security or legal risk, used the Services fraudulently, failed to pay required fees, or otherwise threatened the operation of the Services.
Where appropriate, we may provide notice and an opportunity to resolve the issue before termination.
15. Disclaimers
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
TourVoz does not guarantee that the Services will be uninterrupted, error-free, or suitable for every business purpose.
TourVoz does not guarantee search-engine rankings, website traffic, inquiries, bookings, sales, revenue, or other commercial results from using the Services.
TourVoz does not provide legal, tax, accounting, travel-regulatory, or other professional advice.
16. Limitation of Liability
To the maximum extent permitted by applicable law, TourVoz and its affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, or data arising from or related to your use of the Services.
To the maximum extent permitted by applicable law, TourVoz’s aggregate liability arising out of or relating to the Services or these Terms will not exceed the amount you paid to TourVoz for the Services during the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
17. Changes to These Terms
We may update these Terms as TourVoz and applicable legal requirements evolve.
When we make material changes, we may provide notice through the Services, by email, or by updating the “Last updated” date on this page.
